ChessMatec Privacy Policy

This Privacy Policy governs the privacy practices with respect to your use of the CHESSMATEC Software and Service at the

websites: http://www.chessmatec.comhttp://www.shahmatec.co.il/, http://www.chessadmin.com (collectively, the "Website") and the CHESSMATEC App ("The Software"). This Privacy Policy constitutes part of the CHESSMATEC Terms of Use available at http://www.chessmatec.com and constitutes part thereof.

By using our Website, service (the "Service") and/or accepting the Terms of Service, you consent to the collection and use of your information as we have outlined in this Policy. Capitalized terms used and not otherwise defined herein, shall have the respective meanings ascribed to them under the CHESSMATEC Terms of Use and Service.

Chessmatec is an online service for engaging in online gaming that teaches chess to children, via various puzzles, videos, and additional teaching methods.

We collect information about you either directly from you or automatically through your use of our Website or Service. The information we collect from you will depend on how you interact with us.  “Personal Information” hereinbelow refers to information that can be reasonably used, alone or together with other reasonably available information, to identify a specific individual. Any information combined with Personal Information will be treated as Personal Information.  You are not obligated to provide us with any information, although we may be unable to provide you with the Service or any part thereof without your information.

We do our best to comply with The Children’s Online Privacy Protection Act (“COPPA”) in the US. We do not knowingly collect Personal Information from children under the age of 13 without appropriate consent. If you believe that we may have collected Personal Information from a child under the age of 13, please contact us immediately at privacy@chessmatec.com.

 

When we describe how we collect, use, and share Personal Information herein below, we are also describing how we collect, use, and share your information if you are a parent or teacher of one of our users, or another Website user over the age of 13.  We also describe separately how we collect, use, and share information from children herein below.

 

​The information we collect and how we collect it

We explicitly ask you when we need information that personally identifies you (“Personal Information “). For example, during the registration process, we will ask you for your name and the business name, e-mail address and other information related to the Service. We shall also collect name of school and class, if applicable. Personal Information is also collected when you contact our customer support, or send us other communication, and sign up for newsletters or special offers. Additional information collected by our Website (and the Service) may include your IP address, web pages that you visit and any other data normally stored in website logs (collectively, the “Information”).

 

We may collect billing and account information for credit cards, payment cards or other payment systems from clients of paid versions of our Service and share this information with our billing and payment processors. We do not store credit card or payment card numbers after they have been forwarded to our billing and payment processors. Needless to say, when we use external service providers for processing payments, the applicable Terms of Service of such third party providers shall apply in in connection with the payment processing.

You must be above 13 years old to use our Service. We do not knowingly collect Personal Information from visitors under the age of 13. We only collect Personal Information through our Service from visitors under 13 where we have received the confirmation (via our Service and in accordance with our Terms of Service) of such student’s school and/or teacher to obtain the required parental consent for that student to use our Service and disclose the Personal Information, or where the parent of a child has signed the child up to use the Service. A parent may sign up his entire family.

Like many other websites, we use "cookies" (a small file sent to your computer by a website to allow the website to store information which uniquely identifies you) or other similar software to collect data in order to assist our users and provide them with a more personal experience visits in our Website. You can always disable cookies in your browser, but please note that if you do so, some (or all) of the features and functionality of our Service may not be available to you.

 

We may also use other technologies to collect anonymous non-personally identifiable information. Such information, which is collected automatically, may include your IP address, browser type, referring website, site usage, UDID, country, and whether you opened emails you received from us. We may also use website analytics to collect analytics-related information pertaining to the Website.

 

What we do with your information we collect

 

All information we collect is stored in secured servers. We use the information for providing the Service and operating the Website, Software and Service, in accordance with our Terms of Service. Among others we shall use the Information in the following manners:


(a) To provide the Service as well as for auditing and improving our Service. 
(b) We may occasionally inform you of new features, functionality, services and products, and other promotions from ChessMatec as well as send you periodic updates, tips and newsletters. You may always opt-out of receiving these correspondences from us by following the unsubscribe instructions included in each Newsletter. Note that regardless of your election, we may continue sending you notices to update you on revisions made to this Privacy Policy or to our Terms of Service. 
(iii) We may use and share Information with certain third-parties that help us operate our Website and Service (i.e. cloud provider, email distribution service providers and other similar service providers). When we use such third parties, we restrict them from using or disclosing the information, except as required to perform services on our behalf or to comply with legal requirements. 
(iv) We may share Information with third parties in limited circumstances, including when complying with legal process, preventing fraud or imminent harm, and ensuring the security of our services. 
(v) We reserve the right to disclose your Information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, or court order/to protect the safety of any person.

 

We will retain your Information for as long as your account is active or as needed to provide our Service. You may cancel your account at any time via the interface of the Service. If you face any problems in canceling your account and you wish that we no longer use or hold your Information, please contact us via privacy@chessmatec.com. We may also retain and use your Information as necessary to comply with our legal obligations, resolve disputes, and enforce our Terms of Service.

When you send an email or other communication to ChessMatec, we may retain those communications in order to process and respond to your requests and improve our Service. Please do not send us any communication which contains confidential information. Since we are not able to evaluate whether such communication contains confidential information or not, we may retain or use such confidential information as aforesaid, and such retention or use shall not be deemed as a breach of any of our obligations herein.

We may disclose general aggregate non-personal information about our users to potential business partners, investors, or the public, but we will not, without your specific permission, disclose any of your Personal Information to third parties.

Except as described herein, we do not disclose your Information or share it with third parties.

 

Information Security

We use industry-standard security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. These measures include internal reviews of our data collection, storage, and processing practices, and security measures. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security.

We restrict access to Personal Information to our employees, contractors, and agents who need to know that information in order to operate, develop or improve our Service. These individuals are bound by confidentiality obligations, and we require all of them to agree to use your Personal Information solely for the purpose for which we provided it to them and in accordance with our privacy policy.

Access to information

Under the Israeli Privacy Act, any person may inspect information kept on him by himself, or through anyone appointed by him, or through his custodian. A person who inspects such information and finds it inaccurate, incomplete, unclear or non-dated, may approach the Company and request it to amend or delete the information.

To make any access requests, changes to your child’s account, the removal of Personal Information collected about you or your child from our Websites or Services (as applicable), or to request that we stop the further collection or use of your or your child’s Personal Information in connection with the Websites or Services (as applicable), please contact us at privacy@chessmatec.com.

Please note that information that you have updated, modified, or deleted may remain viewable in cached and archived pages of the Website until your cache is deleted.

Links to third-party websites and products

Our Websites and/or Software may include links to other websites and/or software whose privacy practices may differ from our own practices. If you submit Personal Information to any of those websites or online services, your information is subject to the privacy policies of those websites and/or services. We encourage you to carefully read the privacy policy of any website you visit.

 

We store the information we collect with www.Heroku.com and we encourage you to review the Heroku Terms of Service and Privacy Policy, as we will not be responsible for what Heroku does with the information.

 

Miscellaneous

  • If ChessMatec becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, we may transfer all Information we have collected from our users in connection with such a transaction. If you believe that we have not adhered to our Privacy Policy, please notify us by email to privacy@chessmatec.com and we will use all commercially reasonable efforts to promptly determine and correct the problem.

 

  • We reserve the right to change this Privacy Policy from time to time, so please review it frequently. If we make material changes to this policy, and you are a registered user of the Service, we will notify you by email.

 

  • This policy shall be construed in accordance with and governed for all purposes by the substantive laws of the State of Israel without regard to conflicts of law provisions. You agree that any claim or dispute you may have against the Company and its affiliates, directors, officers, employees, and representatives must be resolved by a court located in Tel-Aviv, Israel, and waive any jurisdictional, venue or inconvenient forum objections to such courts.
